By using the miidiaCenter.com web site ("Service"), or any services provided by Alessandro Botta, you are agreeing to be bound by the following terms and conditions (“Terms of Service”). IF YOU ARE ENTERING INTO THIS AGREEMENT ON BEHALF OF A COMPANY OR OTHER LEGAL ENTITY, YOU REPRESENT THAT YOU HAVE THE AUTHORITY TO BIND SUCH ENTITY, ITS AFFILIATES AND ALL USERS WHO ACCESS OUR SERVICES THROUGH YOUR ACCOUNT TO THESE TERMS AND CONDITIONS, IN WHICH CASE THE TERMS “YOU” OR “YOUR” SHALL REFER TO SUCH ENTITY, ITS AFFILIATES AND USERS ASSOCIATED WITH IT. IF YOU DO NOT HAVE SUCH AUTHORITY, OR IF YOU DO NOT AGREE WITH THESE TERMS AND CONDITIONS, YOU MUST NOT ACCEPT THIS AGREEMENT AND MAY NOT USE THE SERVICES. Alessandro Botta reserves the right to update and change the Terms of Service from time to time without notice. Any new features that augment or enhance the current Service, including the release of new tools and resources, shall be subject to the Terms of Service. Continued use of the Service after any such changes shall constitute your consent to such changes. You can review the most current version of the Terms of Service at any time at this page. Violation of any of the terms below will result in the termination of your Account. While Alessandro Botta prohibits such conduct and Content on the Service, you understand and agree that Alessandro Botta cannot be responsible for the Content posted on the Service and you nonetheless may be exposed to such materials. You agree to use the Service at your own risk. miidiaCenter provides 2 kinds of services: •Search engine and indexation of contents from the public Web •Your own private audio/video library Each customer must respect some resource limitations when using his private media library, such as used disk space and monthly traffic. The values of those limits vary for the different subscription offers, and are specified on the Offers page. When an user exceeds his monthly traffic limit, we will suspend the service for that user until the next month of usage begins. •The search engine Service is free for use and does not require registration, but the personal media library Service requires registration and a payed subscription. •Accounts registered by "bots" or other automated methods are not permitted. •You must provide your valid email address, and any other information requested in order to complete the signup process. •Your login may only be used by one person – a single login shared by multiple people is not permitted. •You are responsible for maintaining the security of your account and password. Alessandro Botta cannot and will not be liable for any loss or damage from your failure to comply with this security obligation. •You are responsible for all Content posted and activity that occurs under your account. •You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright or trademark laws). •You certify that you own the rights to reproduce the content that will be transferred to miidiaCenter.com servers. •The services provided by Alessandro Botta's miidiaCenter.com portal are created as accurately as possible. •Alessandro Botta can not be deemed guilty of eventual , direct or indirect , damages that may derive from it. •The technology of miidiaCenter's search engine automatically produces search results that reference resources located anywhere in the world and accessible by means of the Internet. •Alessandro Botta has not control over information that come from the search engine, does not provide any guarantee on it and , in particular , on its quality , content and accuracy. •Alessandro Botta is not the responsible if search results cause the consultation of contents considered unwelcome or not relevant with the purpose of a research. •Since some of contents on the Internet can be considered appropriate for an adult audience only , or they can house abusive subjects , Alessandro Botta alerts that search engine researches could , automatically and inadvertently , produce links towards such contents , and he does not take charge of it. The media library Service is billed in advance on a three-monthly, yearly or biennial basis and is non-refundable. There will be no refunds or credits for partial months of service, upgrade/downgrade refunds, or refunds for months unused with an open account. In order to treat everyone equally, no exceptions will be made. Downgrading your Service may cause the loss of Content, features, or capacity of your Account. Alessandro Botta does not accept any liability for such loss. You are solely responsible for properly canceling your account. An email request to cancel your account is not considered cancellation. You can cancel your account at any time by clicking on the "My Account" link, and then the "Cancel account" link. The "Cancel account" screen provides a simple no questions asked cancellation link. All of your Content will be immediately deleted from the Service upon cancellation. This information can not be recovered once your account is cancelled. If you cancel the Service before the end of your current paid up period, your cancellation will take effect immediately and you will not be charged again. Alessandro Botta, in its sole discretion, has the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other Alessandro Botta service, for any reason at any time. Such termination of the Service will result in the deactivation or deletion of your Account or your access to your Account, and the forfeiture and relinquishment of all Content in your Account. Alessandro Botta reserves the right to refuse service to anyone for any reason at any time. miidiaCenter.com cleans up your library when either you canceled your account, or your paid up period expired from 14 days or more. We collect the e-mail addresses of those who communicate with us via e-mail, aggregate information on what pages consumers access or visit, and information volunteered by the consumer (such as survey information and/or site registrations). The information we collect is used to improve the content of our Web pages and the quality of our service, and is not shared with or sold to other organizations for commercial purposes, except to provide products or services you’ve requested, when we have your permission, or under the following circumstances: •It is necessary to share information in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of Terms of Service, or as otherwise required by law. •We transfer information about you if Alessandro Botta or miidiaCenter.com is acquired by or merged with another company. In this event, miidiaCenter will notify you before information about you is transferred and becomes subject to a different privacy policy. When you register for miidiaCenter.com we ask for basic informations such as your email address. miidiaCenter uses collected information for the following general purposes: products and services provision, billing, identification and authentication, services improvement, contact, and research. Cookies are required to use the miidiaCenter.com service. A cookie is a small amount of data, which often includes an anonymous unique identifier, that is sent to your browser from a web site’s computers and stored on your computer’s hard drive. We use cookies to record current session information. Alessandro Botta uses third party vendors and hosting partners to provide the necessary hardware, software, networking, storage, and related technology required to run miidiaCenter.com. Although Alessandro Botta owns the code, databases, and all rights to the miidiaCenter.com application, you retain all rights to your data. Alessandro Botta may disclose personally identifiable information under special circumstances, such as to comply with subpoenas or when your actions violate the Terms of Service. Alessandro Botta have the right to suspend and/or permanently delete/ban an account when the behaviour associated with it escalates to be not acceptable, no questions asked. This includes but it is not limited to: abusing or exploiting the system, create denial of service, disrupting other people ideas, be offensive about sex, race, religion, spam. We require people to be polite and respectful of each other's idea. We may and will ban forever accounts and ip addresses that does not conform to our behavioural policy. Alessandro Botta may periodically update this policy. We will notify you about significant changes in the way we treat personal information by sending a notice to the primary email address specified in your miidiaCenter.com account or by placing a prominent notice on our site.
